Title: Employee Relations Specialist – Fact Finding

Job Description: AvantGarde, LLC (AG) seeks to engage an Employee Relations Specialist who will perform comprehensive fact-finding case work in support of AG’s federal government clients on a part-time or full-time, ad hoc, as-needed basis. The work ranges from a variety of issues surrounding the independent review and analysis of cases that get referred to the federal Employee Relationship Office. The case load is anticipated to average 12 – 18 cases per year, the work is to be performed 100% remote, home based in coordination with the AG Project Manager and the designated federal client manager.
The WORK
+ Conduct independent fact-finding investigations for complex, highly controversial and precedent setting workplace misconduct / conduct and harassment cases.
+ Review allegations, determine interviewees (names, roles at agency and POC) and identify needed documentation.
+ Develop questions and conduct interviews with appropriate iniduals.
+ Gather necessary documents to support interview statements and draft sworn statements for signature.
+ Analyze all statements and documentation to assess whether allegation(s) are substantiated.
+ Utilize CFR, Part 752 to provide client management with a written report that summarizes the issues and an analysis of substantiated or non-substantiated allegations.
+ Include statements and documentation in reports to support the analysis and conclusions.
+ Identify the causes of any underlying personnel management weaknesses discovered during the fact-finding investigation.
+ Provide briefings to client management and help facilitate discussions on interpretation of applicable laws, rules and regulations to identify next steps.
The REQUIREMENTS
+ Must have four (4) years of experience conducting administrative investigations and drafting reports of investigation or fact-finding.
+ Bachelor’s degree desired. Substitution:
+ A minimum of 10 years’ experience of investigative/employee relations work within the federal government) and
+ must have four (4) years of experience in federal employment law and regulation that includes drafting disciplinary/adverse actions reviewing facts and legal precedents related to misconduct / conduct cases
+ conducting research on MSPB case decisions; or assisting attorneys, or serving as a representative, in disputes before third parties
+ related Bachelor’s degree and Federal Employee Relations Specialist experience at the GS 11/12 equivalent or the equivalent combination of education, training and experience.
+ 8 to 10 years of experience providing employee relations administration, counseling and guidance to federal employees and managers; five of which must have been with an agency of at least 600 employees.
+ In-depth understanding of the impact on negotiated agreements and past practice on employee relations advisory services.
+ Strong oral and written communication skills to communicate with all levels of the workforce related to employee relations matters.
+ Solid interpersonal and communication skills with the ability to communicate and build rapport with colleagues and clients.
+ Proficiency using the Microsoft Office Suite of applications, and advanced skill using Word and Excel.

Job Description
Elwyn seeks a Senior Director of Incident Management and Investigations to lead a dedicated team of investigators and Incident coordinators who are responsible for incident management and investigations under applicable program regulations. The Senior Director ensures compliance with Elwyn policies, regulatory guidelines and licensing requirements. The Senior Director oversees the workflow, reports on trends, and recommends changes. The Senior Director may be required to complete incident coordination duties and conduct investigations from time to time depending on volume and staffing needs. This is a hybrid role with both in office and remote work. The Senior Director must be available to communicate with and assist incident coordinators during evening and weekend hours. In-person work and some travel including airline travel is expected.
ESSENTIAL DUTIES & RESPONSIBILITIES
- Directs and manages regulatory incident management and investigations including planning, supervising, and coordinating the reporting and investigation of state and program required incidents, including abuse, neglect, client rights violations, and exploitation incidents as required by program regulations and organizational policies
- Directs and manages the day-to-day work of incident coordinators and investigators
- Provides leadership and team management to incident coordinators and investigators, monitors and approves timecards, ensures appropriate use of overtime and PTO, participates in recruitment, selection, leadership, coaching, training, performance management, promotion, discipline and termination
- Collaboration and communication: Effectively represents the department and communicating with various stakeholders, including government agencies, community groups, decision-makers, and the public
- Reviews investigation reports prior to administrative wrap-up meetings to ensure they are well written, compliant with regulations and policies and complete
- Attends Administrative Review Committees and supports incident coordinators and investigators in leading, presenting and completing investigation wrap-ups
- Periodically accompanies investigators during investigation activities to model and train on proper investigation techniques and conduct
- Collects, reviews, and refines data to identify trends for specific areas based on investigations and findings
- Helps develop training materials and train organization personnel on incident reporting and procedures.
- Develops recommendations for changes to operational processes based on trends and patterns and presents recommendations to departmental and organization leaders
- Serves as a member of risk, abuse prevention, quality and other committees as requested
- Reviews and contributes to development of plans of correction
- Supports investigation coordinators in managing investigation workflow and queue ensuring that investigations are completed properly and timely in accordance with regulatory and performance based contracting requirements.

- Alerts legal and risk management leaders of incidents and situations that may pose legal risk to the organization
- Maintains current operational knowledge of incident management and investigation requirements in all applicable states

- Develops best practices and participates in drafting policies and procedures for conducting thorough investigations and ensures implementation of such policies
- Ensures that incident reports and the corrective action portions of the administrative reviews are accessible by appropriate Operations and Quality personnel
- Reviews and audits investigation results to ensure that reportable incidents and finalized reports are entered into all systems within assigned timeframes
- Participates in departmental, cross-departmental and corporate meetings as assigned, including in-person attendance when required
- Participates in external informational sessions, trainings, and meetings with regulators and other external stakeholders
- Participates in root cause analysis reviews
- Maintains a current file of all Incident Management bulletins and regulatory standards keeping them accessible to their team and others in the organization as a point of reference

QUALIFICATIONS & SKILLS
- Bachelor’s degree in healthcare, risk management, criminal justice, social work or similar area preferred
- Four (4) years of experience supervising and/or managing incidents or investigations in human services or healthcare
- Four (4) years of supervisory or management experience
- Is currently or has previously been a Pennsylvania Department of Human Services Certified Investigator. Lapsed certification must become current within six (6) months of date of hire and maintained throughout holding this position

- Strong written and verbal communication and interpersonal skills to maintain effective collaborative relationships with internal and external stakeholders including regulators

Responsibilities

Qualifications

Reporting to the Chief Ethics and Compliance Officer, the Senior Compliance Officer, Global Policies, Education, and Investigations is a trusted expert advisor and senior member of the Ethics, Compliance and Privacy department who will play a critical role in advancing the company’s long-term, global strategy and commitment to compliance and ethics by: (1) developing, implementing, and enhancing global compliance and privacy policies; (2) developing, implementing, and enhancing the global compliance and privacy training matrix, including creating training modules and other education and communications support documents; and (3) leading the global compliance investigations team and regularly conducting, managing and reporting on compliance investigations. The Senior Compliance Officer, Global Policies, Education, and Investigations leads a team of global compliance professionals, providing expert direction and guidance, works with other members of the Compliance department, and regularly collaborates with and advises senior leadership across the Jazz global organization, particularly the HR and Legal departments to support the company’s overall global strategic objectives and its strong culture of compliance. This leader will be responsible for managing external counsel and handling sensitive, complex compliance investigations around the globe.
The Senior Compliance Officer, Global Policies, Education, and Investigations has a broad-based knowledge of the compliance and privacy laws and regulations governing pharmaceutical company activities in the US., U.K., EU and other jurisdictions in which the company conducts its business, including but not limited to the False Claims Act, Anti-kickback Statute, Foreign Corrupt Practices Act, EU Whistleblower directives, HIPAA, GDPR, and the UK Bribery Act. The Senior Compliance Officer, Global Policies, Education, and Investigations should have extensive expertise developing global compliance policies and creating effective training programs designed to educate employees of the company about compliance and privacy risk and the importance of following appropriate mitigation strategies and controls to manage those risks. Experience and background in adult learning strategies is preferred. The Senior Compliance Officer, Global Policies, Education, and Investigations must also have extensive experience in managing and conducting compliance investigations within the US and globally, including the ability to coordinate effectively with key stakeholders in the corporate investigations process, such as HR and Legal. The person in this role works autonomously but must also have the ability to work collaboratively across a range of functions and departments. The Senior Compliance Officer, Global Policies, Education, and Investigations is confident and proactive in his/her approach with a strong commitment to ethical decision-making.
Job Responsibilities and Requirements:
Leads a team of compliance professionals to support the strategic objectives of the organization and its commitment to compliance and ethics by:
Developing, implementing, and enhancing a global compliance and privacy policy framework; drafting compliance and privacy policies and standard operating procedures in collaboration with appropriate stakeholders / subject matter experts
Developing, implementing, and enhancing the global compliance and privacy training matrix, including creating training modules and other education and communications support documents such as field guides and/or internal articles or communications promoting compliance and/or privacy.
Leading the global compliance investigations team and regularly conducting, managing and reporting on compliance investigations.
Regularly reviews and updates compliance and privacy policies and the Jazz Code of Ethics to ensure that these address key risk areas and mitigation strategies relevant for Jazz and promote the importance of ethical decision making
Develops and supports compliance and privacy communications and promotional activities across the organization, including planning and implementing communications and activities for Compliance and Ethics Week and Privacy Week.
Creates training modules and other education tools to ensure that Jazz employees, including senior executives and members of the Jazz board of directors are effectively trained on the key laws, regulations, policies, and SOPs relevant for their role.
Chairs the Investigations Oversight Committee and regularly coordinates and collaborates with key stakeholders in the investigations process, including senior global leaders in Legal, HR, and other functions who conduct sensitive, confidential global investigations to ensure consistency in approach, a thorough investigation process of all relevant compliance and privacy issues, consistent, appropriate, and effective corrective actions, and accurate reporting to key stakeholders, including the Chief Compliance Officer and members of the Compliance department, Chief Legal Officer and members of the Legal department, and other senior global Jazz leaders, as appropriate.
Serves as a key member of the Ethics, Compliance, and Privacy lead team, coordinating with other lead team members to advance the department’s goals and objectives and to drive consistency in the approach to compliance and ethics across the company
Stays informed on new laws, regulations, and industry trends affecting the company and ensures that those new developments are appropriately reflected in Jazz Global Compliance and Privacy policies, education and training, and approach to investigation
Willingly assists Compliance Department colleagues with projects and activities in areas outside of his/her primary areas of responsibility as needed to achieve corporate objectives, contribute to a collegial atmosphere and balance workloads.
Requirements of this position include:
10+ years of relevant pharmaceutical compliance and/or privacy experience in-house
Minimum of 8+ years conducting investigations involving healthcare fraud and abuse and/or bribery and corruption matters, particularly in a corporate setting
Law degree preferred, though not required
Strong compliance and privacy policy design and drafting skills; experience drafting policies for a multinational pharmaceutical organization preferred
Extensive experience developing and implementing compliance and/or privacy training, particularly in the corporate setting; experience developing and implementing training and education in a multinational pharmaceutical organization preferred; adult learning expertise preferred
Solid judgment and business acumen and understanding of business operations, particularly in multinational pharmaceutical organizations
Solid understanding of laws and regulations governing the pharmaceutical or healthcare industry both in the US and internationally;
Experience working in a business environment across multiple functions and geographies, with high level of responsiveness and with a strong customer service orientation;
Experience providing strategic advice and guidance to global senior executives;
